Looking
at the way the U.S. Department of Justice Antitrust Division
and the Federal Trade Commission view the sharing of salary
information among like industries, it becomes clear that the
safest way to approach the issue is to adhere to the following
guidelines:
- Use an independent third party to manage the survey process
- Provide data that is at least three months old and not
projections of what an organization plans to do
- Have a minimum of five participants so specific salaries
are not more than 25% of the total
- Aggregate the data so specific salaries can’t be
attributed to specific organizations
- Make sure that the data is disseminated to all participants
